These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Luminous Lens Studio ("Studio," "we," "us," or "our"), governing your access to and use of our website, luminouslens.com, and all related services, including photography sessions, image processing, and product delivery (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

We reserve the right to modify or discontinue any service at any time without notice.
To book a photography session with Luminous Lens Studio, you must complete the booking process outlined on our website or through direct communication with our team. A non-refundable retainer fee, as specified in our pricing schedule, is required to secure your booking. The remaining balance is due on or before the day of the photography session. We accept various forms of payment, including credit cards, debit cards, and electronic transfers. In the event of cancellation by the client, the retainer fee is forfeited. Rescheduling is subject to availability and may incur additional fees.
Luminous Lens Studio retains all copyrights to the images produced during the photography session. Upon full payment, the client receives a non-exclusive, limited license to use the images for personal purposes, including printing, sharing on social media, and creating personal albums. Commercial use of the images is strictly prohibited without prior written consent from Luminous Lens Studio. We reserve the right to use the images for promotional purposes, including website display, marketing materials, and social media posts, unless otherwise agreed upon in writing with the client.
The client is responsible for obtaining all necessary permissions and consents for the photography session, including location permits, model releases, and parental consent for minors. The client is also responsible for ensuring a safe and appropriate environment for the photography session. Luminous Lens Studio is not liable for any damages, injuries, or losses incurred during the photography session due to the client's negligence or failure to comply with these Terms.
Edited, high-resolution images will be delivered to the client within [Number] weeks of the photography session, via a secure online gallery. The client is responsible for downloading and backing up the images. Luminous Lens Studio is not responsible for archiving images beyond [Number] months after delivery. Additional charges may apply for re-delivery of images after this period.
Luminous Lens Studio is not liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to the Services, including but not limited to loss of profits, loss of data, or loss of goodwill. Our liability is limited to the amount paid by the client for the photography session. We are not responsible for events outside our control, such as weather conditions, venue closures, or equipment malfunctions.
Basic image editing and retouching are included in our standard service. This includes color correction, exposure adjustments, and minor blemish removal. Extensive retouching requests, such as body modifications or significant alterations to the image, may incur additional charges. We reserve the right to refuse retouching requests that we deem unethical or beyond the scope of our services. The client acknowledges that the final images are a reflection of our artistic style and that we have the final say in the editing process.
By engaging Luminous Lens Studio's services, you grant us the right to photograph and use images of you and your property for advertising, publicity, and promotional purposes. If you do not wish to grant this right, you must notify us in writing before the commencement of the photography session. If the photography session involves minors, parental or guardian consent is required. Please note that refusing the model release may affect our ability to offer certain services or discounts.
In the unlikely event that Luminous Lens Studio needs to cancel or reschedule a photography session due to unforeseen circumstances, such as illness, equipment failure, or severe weather conditions, we will make every effort to provide the client with reasonable notice and offer alternative dates or a full refund of the retainer fee. We are not liable for any additional expenses incurred by the client as a result of the cancellation or rescheduling.
For photography sessions that require travel outside of Seattle, WA, travel fees may apply. These fees will be discussed and agreed upon before the session is booked. Travel fees may include mileage, accommodation, and other related expenses. The client is responsible for covering these costs in addition to the photography session fee.
You agree to indemnify, defend, and hold harmless Luminous Lens Studio, its officers, directors, employees, agents, and affiliates, from and against any and all claims, damages, liabilities, costs, and expenses, including attorneys' fees, arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Seattle, Washington.
Luminous Lens Studio reserves the right to modify or update these Terms at any time without notice. The most current version of the Terms will be posted on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, strikes, fire, floods, epidemics, or governmental regulations. In such cases, the affected party shall promptly notify the other party and make reasonable efforts to mitigate the impact of the event.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. The remaining provisions of these Terms shall continue in full force and effect.
